The back half of the year is shaping up to be a busy one. We've got a strong line-up of events in development across Australia, tackling the issues shaping construction law right now.
Topics on the agenda include the latest shifts in security of payment, how time and cost risk gets allocated in an age of shocks, the realities of cost-reimbursable contracts, and emerging trends in construction arbitration — brought to you alongside leading firms and practitioners around the country.
There's plenty on for younger practitioners too, with social events and mooting through our Young Construction Committee, and our 2026 mentoring program now open for applications.
And we'll be closing out the year with end-of-year functions in cities around the country.

Where next for the Australian PPP model?
The PPP model has been implemented with success in the Australian market over many decades, but the commercial landscape continues to change. Contractors are pushing back on the traditional PPP risk allocation whereby all construction phase risks are transferred to a D&C contractor via a fixed price, fixed time contract. Governments are responding by saying that they propose to explore new ways of allocating or sharing risks. Is there an opportunity for equity investors to share some of risks that were previously taken by D&C contractors, in a way that provides a better value for money outcome for governments and taxpayers? And how will the desire of parties for more collaborative approaches to procurement and contracting manifest itself in the PPP model? Owen will explore these and other questions.

Major Project Risk Allocation is broken - Who is to blame? What can be done?
Many major projects often suffer from poor risk assessment and allocation whereby the Clients tend to ‘pass down’ the poorly assessed risk to its Contractor/s through various standard disclaimer (exculpatory) clauses. Notwithstanding the current volatile market with COVID-19, we have seen many examples of such consequences of poor risk allocation over the past decade and the corresponding fallout to all parties and the public.
