Review Adjudication

The Society of Construction Law Australia is excited to present a panel discussion in Perth (and live-streamed) on the highly relevant topic of Review Adjudication.

 

The Building and Construction Industry (Security of Payment) Act 2021 (WA) has a review adjudication process that is not found in other States. There has now been some experience with review adjudications under the Act. Legal issues have arisen from that experience. What is the nature of the process? Does error need to be shown on the part of the original adjudicator? Should the review adjudicator approach the review application ‘de novo’? How does it work procedurally? What if there is a jurisdictional issue?

Join us as Scott Ellis, registered review adjudicator and barrister from Francis Burt Chambers along with Greg Steinepreis, Melissa Koo and Rachel Pachacz from Squire Patton Boggs, share their insights into this important area of construction contract dispute resolution.

The presentation will begin promptly at 5:15 pm AWST in Perth (registration from 5:00 pm), with time for an engaging Q&A session at the end. After the formalities, enjoy drinks and light refreshments while networking with fellow professionals from the construction and legal industries.

Barrister, Francis Burt Chambers

Scott practices primarily as an arbitrator, mediator, expert determiner, adjudicator and review adjudicator under the Act and the Construction Contracts Act 2004, Construction Contracts (Security of Payments) Act 2004 (NT) and the Building and Construction Industry Security of Payment Act 1999 (NSW).

He works mainly in the areas of building and construction, mining and joint ventures, access to infrastructure, intellectual property, regulatory matters and commercial and contract disputes.

Greg Steinepreis

Partner, Squire Patton Boggs

Greg advises energy and resources clients on procurement, works and services contracts, project management and dispute resolution. Greg’s specific project experience includes major liquefied natural gas (LNG) and resources projects.

Greg’s involvement in the construction and engineering industry is supported by more than 30 years as a practising international and domestic arbitrator and involvement as a lawyer in construction project dispute resolution.

Melissa Koo
Partner, Squire Patton Boggs

Melissa is a specialist construction lawyer with extensive experience in representing clients on major Australian and international construction, energy and infrastructure projects. She has advised on high value disputes involving complex legal, engineering and construction issues. She has experience acting for Australian and international clients in all dispute resolution forums, including international arbitration, litigation, mediation and adjudication.

She is also experienced in drafting suites of contracts and advising on and negotiating contracting issues arising out of bespoke and Australian and international standard form contracts.

Rachel Pachacz
Senior Associate, Squire Patton Boggs

Rachel is a senior associate in our Energy & Natural Resources Practice Group. She provides contentious and non-contentious advice on construction, energy and natural resources projects. 

Rachel also has experience in international arbitration.
Rachel was the 2022 winner of the Law Council of Australia’s Tom Yuncken Australian Young Construction Lawyer Award.
