Insurance in major construction projects – what you should know

In the complex and booming construction and infrastructure environment, it is important that those involved in projects understand what they are getting in terms of insurance, as not all insurance products are the same. In this presentation, David will highlight the importance of understanding construction risk early on and what to consider in formulating adequate insurance cover for projects. He will cover the different insurance products available as well as contemporary case law to provide an insight into the commercial and legal challenges associated with such insurance products. By sharing industry "lessons learnt", David's presentation will offer key takeaways for contract drafters, dispute lawyers and project managers to minimise and deal with potential insurance related disputes.   About David Weinberger Called to the Bar in 2000, David has broad experience across diverse jurisdictions and areas of law with a specialisation in building and construction and extensive experience in insurance law. Having recently appeared in the Court of Appeal in Mobis Parts Australia Pty Ltd v XL Insurance Company SE  [2018] NSWCA 342 concerning an insured’s entitlement to indemnity for a $62M claim under a Property Damage and Business Interruption Policy, David brings a unique perspective on understanding  what is actually covered under insurance policies when managing risk. David is recommended as a Construction and Infrastructure Junior Counsel (NSW) in the 2019 Doyle's Guide, and a Leading Construction Barrister (NSW) in the 2018 Doyle's Guide. In 2017, David was recommended in the Doyle’s Guide as a Leading Construction and Infrastructure Junior Counsel (NSW) and a Leading Insurance Barrister (NSW).
